How mediation works

A structured, voluntary and confidential process that most matters complete in a handful of sessions.

Step by step

  1. 1. Enquiry and intake

    You call, WhatsApp or email me with a short description of the dispute. I check whether the matter is suitable for mediation and whether there is any conflict of interest.

  2. 2. Convening

    I contact the other party or their advocate, explain the process, and secure their voluntary participation. We agree on dates, venue or online platform, and fees.

  3. 3. Agreement to mediate

    All parties sign a mediation agreement covering confidentiality, good faith participation, authority to settle and the mediator's fee.

  4. 4. Joint session

    Each party tells their story uninterrupted. I help identify the real issues and underlying interests beneath the stated positions.

  5. 5. Private caucus

    I meet each party separately and in confidence to test options, explore realities and narrow the gap. Nothing is disclosed to the other side without permission.

  6. 6. Option building and negotiation

    Parties generate and refine options. The agenda moves from blame to workable, future-focused solutions.

  7. 7. Settlement agreement

    Terms are recorded in a clear written agreement signed by the parties. In court-annexed matters the agreement is filed and adopted as an order of the court.

  8. 8. Follow-up

    Where a matter does not settle fully, partial agreements are recorded and the balance is reported back or returned to the litigation track.

The mediator does

  • Remains neutral and impartial to all parties
  • Manages the process, safety and ground rules
  • Ensures every party is heard and understood
  • Tests reality and helps generate options
  • Protects confidentiality throughout
  • Records and helps formalise the parties' agreement

The mediator does not

  • Does not judge, rule or impose an outcome
  • Does not act as advocate or legal adviser to any party
  • Does not pressure a party into settlement
  • Does not disclose caucus information without consent
  • Does not testify on what was said in mediation
